Attorney Shawn James Haff of The Criminal Defense Law Center of West Michigan has been asked by his clients before, “Am I going to Prison?” This is a complicated question to answer that requires the attorney to know a lot of information that might not be available at the moment the question is asked.
The factors an attorney must consider are things such as:
- What is the nature of the crime?
- Was someone injured?
- Does the person have a prior criminal record?
- What county did the crime take place in?
- What judge will you have?
A person who is convicted of a very serious felony like Criminal Sexual Conduct in the 1st degree is most certainly going to prison. If you are convicted of a felony drunk driving charge you are probably only facing jail time. If your crime was embezzlement, and it was a low amount of money, you may only get probation.
