Improper Storage or Travel of The Blood Test

If your blood is not stored properly, it could become contaminated.  This contamination can create a false result that is above .08BAC. 

When the blood sits around for a certain period of time, microbes that could be around that cause the alcohol content to go up through fermentation.  If the hospital takes your blood draw right away and lab work is performed quickly, the chance if there being a bad rest result is slim. If there is a long wait between the test and when work is performed, it is possible to have a false result. 

The Timing of The Blood Test

For the purpose of your arrest and conviction, the prosecution has to show that you were impaired at the time of the arrest. If your blood test was taken a long time after you were arrested, your BAC could still be over the legal limit of .08  If your BAC was under .08 you may have been able to drive safely. 

Not Enough Sodium Fluoride Was Used

If you are given an OWI blood draw, the blood test has to have sodium fluoride in the tube. It has to be added into the tube.  If the tube has too little Sodium Fluoride, or too much, your blood sample is probably not accurate and needs to be challenged in court. 

Not Enough Potassium Oxalate

Potassium oxalate needs to be in the test tube or else your blood sample will clot. If your ratio of solids and liquids is not correct, your blood alcohol test will not be accurate.
