To better understand this collaboration, we spoke with a private investigator and three lawyers across Toronto and Mississauga about how investigative work supports legal strategy.

Michael Porter, a private investigator with Haywood Hunt & Associates Inc in Toronto, explains that his role often begins where publicly available information ends. While lawyers rely on documentation and client accounts, investigators are brought in to verify those details and uncover additional facts.

He notes that investigations can involve a wide range of activities, from conducting surveillance and locating individuals to analyzing records and identifying inconsistencies. The goal is not simply to gather information, but to ensure that the information is accurate and reliable.

Porter emphasizes that many cases involve details that are not immediately apparent. In these situations, an independent investigation can provide clarity and direction. By working closely with legal counsel, investigators help ensure that decisions are based on verified facts rather than assumptions.

He also highlights the importance of discretion and professionalism. Investigative work must be conducted carefully, as the findings can have a direct impact on legal proceedings. Rose points out that family law cases are often complex and emotionally charged. Investigators can assist by gathering documentation, conducting background research, or observing behaviour relevant to the case.

She emphasizes that the goal is not to escalate conflict, but to ensure that decisions are based on accurate information. When facts are clearly established, it becomes easier to move forward with negotiations or court proceedings.

For Rose, working with a private investigator adds an additional layer of confidence in the case, particularly when dealing with contested issues.

Strengthening Criminal Defence Strategy

Dalraj Bains, a criminal lawyer with Dalraj Bains Professional Corporation in Toronto, explains that private investigators can play a key role in building a strong defence.

He notes that in criminal cases, the outcome often depends on the details. Investigators can assist by locating witnesses, reviewing evidence, and identifying inconsistencies in the prosecution’s case. This work helps ensure that no relevant information is overlooked.

Bains emphasizes that defence preparation requires a thorough understanding of the facts from multiple perspectives. While disclosure from the Crown provides a starting point, it may not always present the full picture. Independent investigation allows the defence to explore additional angles and develop a more complete strategy.

He also points out that timing is critical. Engaging an investigator early in the process can help identify issues before they become more difficult to address. By working collaboratively, lawyers and investigators can ensure that the case is approached in a structured and informed manner.

For Bains, the value of investigative support lies in its ability to strengthen the overall defence and provide a deeper understanding of the circumstances surrounding the case.

For him, collaboration with a private investigator is an important part of ensuring that the defence is thorough, accurate, and well-prepared.
