Statute of Limitations in Michigan CSC Cases

Under Michigan Law, a prosecutor must bring criminal sexual conduct charges against a person within certain period of time. The statue of limitations governs how long after a crime is committed that charges can be brought against a person. For many crimes in Michigan, the statue of limitations is six years. However, Criminal Sexual Conduct crimes are far more serious and therefore have a longer statue of limitations. A prosecutor must charge someone for CSC in the 2nd, 3rd or 4th degree with in ten years or by the alleged victim’s 21st birthday, whichever one comes later. Criminal Sexual Conduct charges in the first degree have no statue of limitations. How Is A Person Charged With Criminal Sexual Conduct?

In order for a person to face a charge for these extremely serious sex offenses, the police must first get a notification if the alleged assault. Once this happens, an investigation will take place. In most instances, the alleged victim reports the offense. This usually happens through a different person. If the victim is a child, they have have told about the assault to a counselor at school who will then notify the police.
